Welcome to Velocity Car Rental (“Velocity,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website (collectively, the “Platform”).

Please read these Terms carefully before using the Platform. By registering an account, booking a vehicle, or listing a vehicle, you explicitly agree to be bound by these Terms.

If you do not agree, you must immediately cease using the Platform.

    1. Nature of the Platform

Velocity provides an online peer-to-peer marketplace that connects vehicle owners (“Hosts”) with individuals seeking to rent vehicles (“Guests”).

 

  1. User Eligibility and Verification

To register an account and use the Platform, you must meet and maintain the following criteria:

  • Age Requirement: You must be at least 18 years old (21 years old in certain jurisdictions or for premium vehicle tiers) to book or list a vehicle.
  • Driver’s License: Guests must possess a valid, current, and unexpired driver’s license issued by a government authority.
  • Identity Verification: You authorize Velocity Car Rental to conduct identity, background, and driving history checks through third-party databases. We reserve the right to deny access to the Platform based on our proprietary screening criteria, driving records, or background reports.
  • Account Security: You are entirely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  1. Specific Terms for Guests (Renters)

By booking a vehicle on Velocity Car Rental, Guests agree to the following operational rules:

  • Permitted Driving: Only the specific primary Guest who booked the vehicle, or an “Approved Additional Driver” explicitly added and verified via the Platform, is legally authorized to operate the vehicle.
  • Prohibited Uses: Vehicles booked on the Platform must never be used for:
    • Commercial ride-sharing, courier, or delivery services (unless explicitly permitted under a separate tier agreement).
    • Street racing, track testing, off-roading, or stunts.
    • Towing or pushing heavy loads without the Host’s explicit permission.
    • Transporting illegal cargo, hazardous materials, or driving under the influence of drugs or alcohol.
  • Vehicle Care: You must return the vehicle at the designated time, location, and in clean condition. Pets and smoking are strictly prohibited unless otherwise indicated by the Host’s listing rules. Extra cleaning, smoking, or refueling fees will apply if violated.
  1. Specific Terms for Hosts (Vehicle Owners)

By listing a vehicle on Velocity Car Rental, Hosts agree to the following structural requirements:

  • Vehicle Condition: You guarantee that any vehicle you list is legally registered, properly insured, and mechanically sound. It must meet all local safety, smog, and inspection criteria.
  • Exclusive Availability: You agree to maintain accurate availability calendars. Canceling active bookings without cause disrupts the marketplace and will trigger cancellation penalties, financial assessments, or account suspension.
  • Tracking and Privacy: If you equip your vehicle with a GPS tracker, dashcam, or telematics device, you must explicitly declare this inside your vehicle listing details. Interior-facing cabin cameras or audio recorders are strictly banned during an active booking.
  1. Limitation of Liability and Indemnification
  • Limitation: Velocity Car Rental, its directors, employees, and affiliates shall not be held liable for any indirect, incidental, special, exemplary, or consequential damages resulting from vehicle mechanical failure, structural collisions, bodily injuries, or misconduct of users on the platform.
  • Indemnity: You agree to indemnify, defend, and hold harmless Velocity Car Rental from and against any and all claims, liabilities, losses, damages, or expenses (including attorney’s fees) arising out of your breach of these Terms, misuse of the Platform, or your violation of any third-party safety rights.
  1. Dispute Resolution and Arbitration
  • Mandatory Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the breach thereof will be settled by binding, individual arbitration administered by the American Arbitration Association (AAA) or a local regional equivalent, rather than in a court of law.
  • Class Action Waiver: You and Velocity Car Rental explicitly agree that each party may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.
  1. Account Termination

Velocity Car Rental reserves the absolute right, without notice and at its sole discretion, to terminate or suspend your account, remove listings, or restrict your access to the Platform for any reason, including but not limited to safety violations, low user ratings, fraudulent behaviors, or failure to comply with these Terms.
